Terms

This is an online only auction.

All items sell as is, where is with any and all faults or flaws. Items sell with no warranty stated or implied. Items have not been tested by the auction company unless it is stated in the item description.

STAGGERED/DYNAMIC CLOSING: The standard online auctions will begin closing at 7:00 PM Central Time on announced date for each specific auction. The auction will close 5-8 items every minute, starting at 7pm CST- Standard overtime bidding rules will apply.  If there are any bids within the last minute, there will be an auto extend bidding time of 3 minutes. The closing time of each lot will be automatically reset to 3 minutes whenever a bid is placed within the last minute on that lot.

ALL ITEMS MUST BE REMOVED WITHIN 2 DAYS OF THE CLOSE OF THE AUCTION! Any items still in our yard after 2 days from the close of auction will incur a $10 per day storage charge per item.

LOAD OUT/PICK-UP LOCATION: 8025 State Hwy 25, Monticello MN 55362, auction company will have skidloader on site to assist buyers with loading.

SHIPPING: Elsenpeter Auctions WILL NOT offer shipping for this auction. 

AGE REQUIREMENT: All bidders must be at least 18 years of age to purchase.

BUYER'S PREMIUM: There is a 10% buyer's premium in effect for items up to $10,000.00 and 5% for items $10,000.01 to $20,999.00 And 3% for items $21,000.00 and Higher.  Example: If you bid $100.00, you will be charged $110.00 at check out.

PAYMENT: Accepted forms of payment include:

  • New bidders (bidders that have not purchased from us before) that spend over $2,000 must pay by bank wire transfer or cash or cashier's check. We will email you our bank wire transfer information the morning after the auction.
  • Visa, MasterCard, Discover or American Express (with a 3% convenience fee). We do not accept credit or debit cards on transactions over $1,000 from new customers or on titled vehicles.
  • Personal And Business Checks Are Not Accepted.

  • Cashier's Check
  • Cash
  • Payment must be made when items are picked up or before you send your shipper. Items must absolutely be paid for within 2 days of the close of the auction, no exceptions.

SALES TAX: Items being sold in this auction require sales tax of 7.375% to be charged. Titled vehicles require 6.5% sales tax to be charged at the time of registration in the buyer's licensing jurisdiction.  $65 document fee on all titled items and $25 document fee on any DNR items.  

Sellers that have items consigned to this auction are strictly prohibited from bidding on their own items.

WARRANTY & CONDITION OF ITEMS SOLD: All items are sold 'AS IS, WHERE IS, with NO WARRANTY expressed or implied. It is the responsibility of the buyer to determine the condition of the items and bid accordingly. Descriptions are believed to be accurate but not guaranteed. When you are not certain of the condition or use of an item please bid accordingly.

CATALOG DISCREPANCIES: You are bidding on the described item not the photograph, occasionally the wrong photo may be displayed, always read the item description.

The auctioneer reserves the right to add or remove items from the auction. The auctioneer reserves the right to cancel, suspend, extend or reschedule an individual item and or auction event or to make changes to the auction closing times or inspection or removal times.

In the event a winning bidder does not pick up their items on the advertised pickup dates or make arrangements for payment by the end of the last pick up day the Auction Company has the right to sell the items to a back up bidder if they choose. Additionally, the Auction Company may at their discretion permanently ban the non paying bidder from doing business with Elsenpeter Auctions & Real Estate, Inc. in all future auctions.
